Marvin P. Pastel, II, is a founding partner of Winter Capriola Zenner and a senior member of the firm’s Community Association and Construction Litigation practice groups. His practice encompasses both litigation and transnational matters within the field of community association law. He represents homeowner and condominium associations across Georgia in a wide range of matters, including assessment collections, amendments to governing documents and bylaws, breach of the governing documents, board of director disputes, and all other areas of community association disputes. His practice involves addressing emerging and often contentious legal challenges within community associations, including regulating or prohibiting short-term rentals like Airbnb, addressing illegal leasing practices, and resolving disputes.

Marvin has substantial knowledge in general construction litigation. He is one of the nation’s leading experts in representing insurance disaster restoration contractors.

Before entering the legal profession, Marvin served as the financial officer and controller for a large regional contractor specializing in excavation, highway, railroad, real estate development, sewer, and mining projects. This business experience complements his legal practice, particularly in matters involving construction and real property.

Marvin holds an AV® Preeminent rating from Martindale-Hubbell, the highest possible peer rating for professional excellence and ethical standards. He has been named to the Super Lawyers® list annually since 2015. Marvin is an accredited LEED (Leadership in Energy and Environmental Design) Green Associate and holds a deep understanding of the most current building principles and sustainability standards.

Marvin earned his B.S. and M.B.A. from the University of Virginia and his J.D. from Florida State University College of Law, where he served as editor on the Florida State Law Review.

Marvin is president of his neighborhood park, Mountain Way Commons. He is also very active in Citizens’ Climate Lobby, a national organization seeking to curb climate change. Outside of the office, Marvin enjoys section hiking the Appalachian Trail and building models of sixteenth and seventeenth-century ships. He is also a self-proclaimed book and movie buff.
